The article argues for the necessity of designing the philosophy of contract and submits its rough outlines. The underlying idea is that the general theory of contract (the contract as such) should be considered as the foundation and central part of the philosophy of contract. The author defines the contract as an act of volition, discloses the nature of the contract as a social regulator of prime importance, provides definitions of the legal, non-legal, political, household and industrial contracts. He shows the role of the contract as an indispensable means of interaction between people, as well as its civili- zational importance which is determined by the nature of contract as an act expressing the common will and connecting persons who conclude the contract in their own interests.
Обоснована необходимость разработки философии договора, намечены ее контуры в первом приближении. Изложена идея, согласно которой основанием и центральным разделом философии договора должна быть общая теория договора (договора вообще). Сформулировано понятие договора как волевого акта, раскрыта сущность договора как важнейшего социального регулятора, даны определения договора: правового, неправового, политического, бытового, производственного. Показана роль договора как незаменимого средства взаимодействия людей, социальная поистине цивилизационная ценность которого обусловлена природой договора как акта, выражающего общую связующую волю лиц, совершающих его в своих интересах.
